Contrary to common perception, property settlements are not always based on a 50-50 division of the marital estate. I work closely with our clients to help them determine the value of the marital estate and how to equitably divide marital property. Often property division matters can be worked out through mediation, based on the needs of the parties. One party may want the house while the other may be concerned about protecting a business interest or retirement account.

Even in cases where property division matters can be worked out in mediation, it may be in my client’s best interest to initiate a court proceeding to obtain restraining orders that prevent the sale or transfer of assets and to require full disclosure of assets. Many couples maintain personal and joint accounts, and it is easy to overlook assets maintained by a former spouse.

What is important to remember is that there is no one way to determine who retains what assets, whether a decision is made through negotiation or litigation. Even judges use a variety of factors to determine the equitable distribution of the marital estate. Who gets 401ks, stocks, IRAs, investment accounts, and the family home are all issues that can be negotiated by the parties of left the court to decide. I work with my clients to ensure that they are treated fairly whether property division matters are decided by the parties or by a judge.
